It has now been a month since the introduction of the new divorce Law. The Divorce, Dissolution and Separation Act 2020 which came into effect on 6th April 2022 removes the requirement to demonstrate anything more than the ground that a marriage has irretrievably broken down when making a divorce application. This means that there is no fault apportioned in the making of the application.
The amount of divorce applications has significantly increased since the new law...
Data from the HM Courts and Tribunals Service (HMCTS) shows that 3000 divorce applications were made in the first week of the new law! This is a significant increase in the number of applications made – a 50% rise in applications made. Research shows that some people have been waiting for this new law to make their application for divorce.
