Sir Andrew McFarlane, President of the Family Law Division has stated that there will be a general steer towards more family court hearings being attended rather than remote where possible where there is an important decision to be made. For the immediate present, however, HMCTS will continue to apply the social distancing requirements and other measures that have been in place for many months.
He has stated that this is justified as attendance at court is often a requirement and so there is responsibility to do what can be done to reduce infection. We have noticed from our local court that first appointment listings will usually remain remote, however, as the case progresses hearings are more often ordered to be attended.
