With the wedding season upon us, legal advice is often the last thing on a bride or grooms mind.  However, a Pre-nuptial Agreement could be the protection they need at this crucial point in their lives.

Marriage has important legal implications for both parties and a Pre-nuptial Agreement can help protect both participants in the future. It is a formal, written agreement and is usually prepared in advance of the wedding ceremony (although an agreement can be entered into afterwards as a Post-nuptial Agreement). A Pre-nuptial Agreement will outline the intentions of both parties, setting out what will happen to their assets, including money, possessions and property, if the marriage were to end.

Although Pre-nuptial Agreements are not yet legally binding, they demonstrate the intentions of both parties with the family court.  To encourage the family court to give the document weight, you should consider seeking independent advice from a family law specialist, at least two months in advance of the wedding date.
